Acceptable UsagePolicy

1. Purpose and scope

This Acceptable Usage Policy (“AUP”) sets out which uses of the “Orbance” event software platform are permitted or prohibited. The platform is provided by Wiedenroth Technologies GmbH, Speicherstraße 9, 31134 Hildesheim, Germany (“Wiedenroth Technologies”).

Orbance is a technical SaaS platform for organizing and managing events, operating ticket shops (including custom domains and subdomains such as anbieter.shop.orbance.com), processing payments via connected payment service providers, and managing and communicating with participants.

Organizers (“Users”, including organizations and companies) remain solely responsible for their events, content, offers, ticket sales, and compliance with applicable law. Wiedenroth Technologies provides the technical platform and does not become a party to the purchase contracts between organizers and ticket buyers.

This AUP supplements the Orbance Terms of Service and is not a substitute for them. In the event of a conflict, the Terms of Service prevail unless expressly stated otherwise. The AUP applies to all platform users, especially event organizers acting as sub-merchants for connected payment service providers.

2. Acceptable use

Orbance may be used for lawful purposes, in particular for:

  • Creating and managing events
  • Selling and managing tickets and operating ticket shops
  • Participant management, including registration and attendance tracking
  • Communicating with participants in connection with events
  • Lawful business or private events, provided no legal prohibitions or restrictions apply

Use must always comply with applicable law, the Terms of Service, this AUP, and the terms of the relevant connected payment service providers (e.g. Stripe Connect, PayPal Commerce).

3. Prohibited use

The following uses are prohibited. The list is not exhaustive; any use that violates applicable law, the Terms of Service, or the legitimate interests of the platform, payment service providers, or third parties is also prohibited.

3.1 Illegal events and content

  • Events or content that violate applicable law
  • Events held without required permits, licenses, or authorizations where these are legally required
  • Fraud or deception of participants, including misleading information about location, time, scope of services, or availability
  • Fake events or selling tickets for non-existent, fabricated, or clearly non-deliverable events

3.2 Payment and financial abuse

  • Money laundering or other misuse of payment instruments
  • Use of another person’s payment data without authorization or other unauthorized use of payment methods
  • Fraudulent, fictitious, or abusive transactions
  • Circumventing identity, risk, or payment checks by the platform or connected payment service providers
  • Using payment features for purposes unrelated to lawful ticket sales or event-related services

3.3 Third-party rights

  • Infringement of copyrights, related rights, or neighboring rights
  • Trademark infringement or unauthorized use of third-party marks
  • Use of protected content, brands, logos, or materials without sufficient authorization

3.4 Harmful or unlawful content

  • Incitement to violence or other solicitation of criminal acts
  • Discriminatory, hate-inciting, or extremist content where prohibited by applicable law
  • Offering or facilitating illegal services or goods via the platform
  • Content constituting hate speech, defamation, or other unlawful harm to third parties

3.5 Technical abuse

  • Attacks on the platform, its infrastructure, or connected services (including denial-of-service, malware injection, or similar acts)
  • Unauthorized reading, copying, alteration, or deletion of data
  • Circumventing technical or organizational security measures
  • Spam or other abusive, unsolicited, or unlawful bulk messaging via Orbance or connected SMTP configurations
  • Unauthorized sharing of credentials or access to protected areas of the app

4. Requirements for organizers (sub-merchants)

Organizers who use Orbance for ticket sales and payment processing act as independent merchants (sub-merchants) toward ticket buyers and connected payment service providers. They undertake in particular to:

  • provide accurate, complete, and current business, contact, and identity data and update it promptly when it changes
  • remain solely responsible for their own events, content, prices, availability, and cancellation or withdrawal terms
  • comply with tax, consumer protection, competition, and event-related legal obligations
  • ensure any required permits, licenses, and other legal prerequisites for the relevant event
  • maintain a complete, current, and legally compliant imprint, privacy policy, and terms and conditions in the ticket shop
  • lawfully set up, verify, and use payment accounts (e.g. Stripe Connect, PayPal Commerce)

5. Monitoring and enforcement

Wiedenroth Technologies may monitor and review platform use to the extent legally permitted and technically reasonable in order to detect abuse, protect platform integrity, and meet obligations toward payment service providers and authorities. Comprehensive or complete manual review of all content, events, or transactions is not performed and is not warranted.

Where there are indications of violations, Wiedenroth Technologies may in particular:

  • manually review flagged content, accounts, or transactions
  • receive and evaluate reports from users and third parties
  • restrict or suspend accounts and disable individual features (e.g. ticket shop or email sending)
  • remove unlawful or prohibited content or prevent its distribution
  • cooperate with payment service providers in connection with irregularities, where legally permitted and necessary
  • terminate the user agreement for cause

Statutory review, information, and cooperation obligations remain unaffected. Measures are taken at reasonable discretion, taking into account the severity and urgency of the matter.

6. Reporting violations

Reports of unlawful content, suspected fraud, or platform abuse may be submitted via the following channels:

Please provide as much concrete detail as possible (e.g. affected URL, event, shop domain, time period, and description of the issue) so that a timely review is possible.

7. Changes to this policy

Wiedenroth Technologies may amend this AUP at any time, in particular due to changes in law, platform features, or payment service provider requirements. The current version is published on this page. Material changes may also be shown in the app. If the User continues to use the platform after notice, the amended provisions are deemed accepted to the extent permitted by law. If the User rejects the changes, they must delete their account.
